A power of attorney is typically given to someone close to you, such as a direct family member (brothers, sisters, adult children etc.). It gives them a range of powers, allowing them to make important decisions on your behalf.

WHAT POWERS DO THEY GIVE?

A power of attorney gives your appointee (the attorney) the legal authority to make a range of decisions on your behalf. Specific agreements may vary, but examples include:

  • Dealing with local authorities, such as the council

  • Financial decisions

  • Whether you should be placed in a care home

  • Whether you should receive medical treatment

  • General welfare and daily care arrangements

  • Managing properties

They cannot be used to make decisions you cannot normally do (e.g. something illegal), go against any advanced decisions you made (e.g. if you refuse certain medical treatments), or deprive liberties and rights. WHAT TYPES ARE THERE?

There are two main types you should consider:

  • Ordinary/limited: these are used when you want someone to make decisions over a temporary period (e.g. if you are abroad, or temporarily ill/injured), and typically limited to financial decisions.

  • Lasting: these are lifelong agreements covering health, welfare and financial decisions. These are made whilst you still have the ability to make decisions for yourself and can only be cancelled by yourself (providing you still have the mental capacity) or the attorney.
